Cleaning Services Agreement
This Agreement is made and entered into by and between ANNS Cleaning Service LLC, and the persons and/or company as described in the attached electronic Estimates, Work orders and Invoices. This agreement will be attached to all electronic Estimates, Work orders and Invoices.
By hiring ANNS Cleaning Service LLC you agree to everything hereunder.
1. Services
This agreement between ANNS Cleaning Service and the Customer outlines the provision of home cleaning services at the Customer's residence. The specific services, scope of work, and pricing are detailed in the attached electronic estimate, work order, and invoice, which are incorporated into and made a part of this agreement by reference.
2. Customer Responsibilities
Customer agrees to:
Provide a Safe Working Environment: Customer shall ensure that the premises where the Services are to be performed are safe for ANNS Cleaning Service employees. This includes, but is not limited to, providing adequate lighting, removing obstacles from walkways, and ensuring that all stairs and steps are in good repair.
Notify of Hazards: Customer shall promptly notify ANNS Cleaning Service of any known or suspected hazards on the premises.
Customer Provided Cleaning Products: Customers may provide cleaning products of their choosing but may not apply cleaning products on the employees behalf. Proper ventilation is required as per the manufacturers recommendation and as required by all local laws.
Smoking: Customers may not smoke near the employees or in confined areas without proper ventilation.
Cancellation Policy: Customer shall provide ANNS Cleaning Service with at least 24 hours' advance notice of any cancellation of scheduled Services. Cancellations with less than 24 hours' notice may be subject to a $50 cancellation fee.
3. Payment
The cost of the Services is detailed in the attached electronic estimate, work order, and invoice. Payment is due upon completion of the Services, or as otherwise specified in a mutually agreed-upon payment schedule. Further services will not commence until all outstanding payments are received in full. Delinquent payments will be subject to additional fees and charges as outlined in the attached documents. For balances exceeding $2,000, we reserve the right to file a mechanics lien on the property when applicable and pursue legal action to recover the outstanding debt. All costs associated with pursuing legal action to recover an outstanding balance shall be paid for by the customer.
In the event that payment is not received by the due date, a late payment fee of ten percent (10%) of the total outstanding balance shall be applied. This fee will accrue every thirty (30) days from the original due date until the balance is paid in full.
Unforeseen Costs:
Please be advised that while we strive to provide accurate estimates, the final cost of our home cleaning services may be subject to change due to unforeseen circumstances and conditions not readily apparent during the initial consultation or phone estimate. These may include, but are not limited to:
Excessive Soiling: Homes with significant amounts of accumulated dirt, grime, or other debris that require additional time, labor, or specialized cleaning products.
Unexpected Obstacles: Obstructions, such as furniture, personal belongings, or other items that impede access to areas requiring cleaning.
Hidden Damage: The discovery of pre-existing damage, mold, or other issues that require specialized cleaning or remediation beyond the scope of the original estimate.
Unforeseen Hazards: Situations involving hazardous materials, biohazards, or other conditions that necessitate additional safety precautions or specialized cleaning protocols.
Accessibility Issues: Difficulties accessing certain areas of the home due to structural limitations, security concerns, or other factors.
In the event that any of these or other unforeseen circumstances arise, we will notify the client as soon as reasonably possible and provide an updated estimate for the additional services required. We will not proceed with any additional work or incur any extra costs without the client's express consent. The client understands and agrees that the final cost may exceed the initial estimate due to these unforeseen circumstances. We will make every effort to minimize any additional costs and provide transparent communication throughout the cleaning process.
4. Termination
This Agreement may be terminated by either party upon one or more days' notice to the other party.
5. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
6. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Rhode Island and the State of which the work is being performed.
7. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
8. Notices
All notices and other communications hereunder shall be in writing and shall be deemed to have been duly given when delivered personally, sent by certified mail, return receipt requested, or sent by overnight courier service, addressed as follows:
If to Company: ANNS Cleaning Service LLC
If to Customer: As described in the attached electronic estimates, work orders and invoices.
IN WITNESS WHEREOF, the parties have executed this Agreement.
